   I contacted AdSense years ago about it and they said it is ok.
   
   However you might want to ask Google yourself to make sure.
   
   Only they can tell you what they think is ok.
   
   ps: you might want to check the behaviour of this ad when screensize is smaller than navigation + ad size. If it overlaps each other you might be in violation of AdSense TOS

     Thanks for the heads up, what is the best way to contact the Adsense team? I can't find like a contact us button or something, it all directs me to help topics and such.
