Is it a must to have a disclaimer, TOS and privacy on any site that has adsense ads on it?

Could google penalize sites that have ads but not these pages?

    I know they were enforcing the privacy policy page at some point in time.

    About the TOS no, all they want is the bit of text about the cookies set by adsense ads.
